Windsor Town Council Directs Regulation on Use of Recreational (Non-Medical) Marijuana

On March 29, 2017, the Windsor Town Council held a noticed public meeting to consider what permanent regulations should be adopted for recreational (non-medical) marijuana, in response to Proposition 64.  At the conclusion of this meeting, the Town Council directed staff to prepare the necessary ordinances that would prohibit the following uses and activities related to recreational (non-medical) marijuana within the Town of Windsor:

            -  Outdoor cultivation at a private residence for personal use.
            -  Retail sales / dispensing of recreational marijuana or any product containing  
               marijuana or its by-products.
            -  All commercial cultivation of recreational marijuana.
            -  Manufacturing, processing, warehousing or distribution of any product containing  
               marijuana or its by-products.
            - Delivery of recreational marijuana to any property within town limits.
            - Cultivation, manufacturing and processing of Industrial Hemp.

Proposition 64, the voter-approved ballot measure that legalized use of recreational marijuana in California, mandates that all jurisdictions in California must allow for indoor cultivation of up to six recreational marijuana plants at a private residence for personal use. The Town Council directed that an administrative permit requirement be established for indoor cultivation of recreational marijuana at a private residence, and that minimum safety requirements be imposed through the permit process. 

Town of Windsor staff anticipates that the draft ordinances will be presented to the Town Council for review and adoption in Summer, 2017.
