Adoption of Enforceable Obligation Payment Schedule
On August 25, 2011, the Town of Windsor Redevelopment Agency adopted Resolution No. 2831-11 adopting an Enforceable Obligation Payment Schedule (EOPS). On September 27, 2011, the Town of Windsor Redevelopment Agency adopted Resolution No. 2844-11 adopting an Amended Enforceable Obligation Payment Schedule (EOPS). A copy of the EOPS and the amended EOPS was provided to the California Department of Finance, State Controllers Office and the County of Sonoma Auditor-Controller. The amended EOPS lists all of the obligations that are “enforceable obligations” within the meaning of subdivision (d) of Section 34167 of the California Redevelopment Law.
On December 29, 2011, the California Supreme Court (“Court”) upheld ABx1 26 requiring dissolution of all redevelopment agencies. AB 26 requires each Agency to readopt an EOPS by February 1, 2012 for the period from January 1 through June 30 that lists all of the obligations that are considered “enforceable obligations” of the Agency. Agency staff reviewed the previous EOPS as amended on September 21, 2011 and updated the payment schedule to reflect a more complete list of the Agency’s enforceable obligations requiring payment through June 30, 2012.
On February 15, 2012 the Town of Windsor acting as Successor Agency to the Former Windsor Redevelopment Agency adopted Resolution 2885-12 adopting an Amended Enforceable Obligation Payment Schedule for the period from January 1, 2012 through June 30, 2012 pursuant to Health and Safety Code Section 34177(a)(1).
